(04.10.06) UPDATE
Lawsuit Dismissed
Friday, March 31, 2006
Calgary--- Durocher Simpson, Barristers & Solicitors (Edmonton, Alberta, Canada) Terry J. Thomas, counsel for HelixSphere Technologies by way of court application, successfully struck the claim/action against 744353 Alberta Ltd., a wholly owned Canadian subsidiary. HelixSphere's counsel has been granted leave by the court for the opportunity to bring forward application for solicitor/client costs in this matter.
The original claim disputed the rights/ownership to the technology and related trade secrets, which were purchased from Helical Dynamics International by 744353 Alberta Ltd.
Company President, Robert Chin states that this claim/action against the Company has had the effect of "a large ball and chain" and has hindered the efforts of the Company to secure investment capital, and as well, was a deterrent for other parties as HelixSphere pursued development of its acquired technologies, business relationships and new opportunities. There remain challenges for the Company, but HelixSphere is determined to tackle them one by one.
HelixSphere, unsatisfied with its previous counsel, recently engaged Mr. Terry J. Thomas of Durocher Simpson and is very pleased with his effective and efficient handling of matters on behalf of the Company.
